Chapter 1 General Provisions

Article 1 These Regulations are formulated in accordance with the provisions of the Law of the People 's Republic of China on Entry - and Exit Animal and Plant Quarantine (hereinafter referred to as the Entry and Exit Animal and Plant Quarantine Law).

Article 2 The following items shall be subject to quarantine according to the provisions of the Entry and Exit Animal and Plant Quarantine Law and these Regulations:

(A) the entry, exit, transit of animals and plants, animal and plant products and other quarantine objects;

(2) loading containers, packaging materials, bedding materials for loading animals and plants, animal and plant products and other quarantine objects;

(C) from the animal and plant epidemic areas of transport;

(4) waste ships for dismantling;

(5) Other goods and articles that shall be subject to the provisions of laws, administrative regulations, international treaties or trade contracts that shall implement the entry and exit of animal and plant quarantine.

Article 3 The competent department of agricultural administration under the State Council shall be in charge of the quarantine of animals and plants throughout the country.

The Animal and Plant Quarantine Bureau of the People 's Republic of China (hereinafter referred to as the State Animal and Plant Quarantine Bureau) shall jointly manage the national quarantine of animal and plant animals and plants, collect the epidemic of major animals and plants at home and abroad, and be responsible for the cooperation and exchange of international animal and plant quarantine.

The State Animal and Plant Quarantine Administration shall, in accordance with the provisions of the Entry and Exit Animal and Plant Quarantine Law and the provisions of these Regulations, implement the entry and exit animal and plant quarantine office at the port animal and plant quarantine office established at the port where the opening of ports and the entry and exit of animal and plant quarantine operations are concentrated.

Article 4 The following emergency precautions shall be taken according to the circumstances when a major flora and fauna epidemic is likely to be introduced into China:

(1) The State Council may take control measures in the relevant border areas and, if necessary, order the prohibition of the entry of the means of transport from the animal and plant epidemic areas into or block the relevant ports;

(2) The competent agricultural administrative department of the State Council may publish a list of animals and plants, animal and plant products and other quarantine objects that are prohibited from entering the country and region where the epidemic of plants and animals are popular;

(3) The relevant port animal and plant quarantine office may take emergency quarantine measures for the items of entry in Article 2 of these Regulations which may be contaminated with pests and diseases;

(4) The local people's government of the area threatened by the animal and plant epidemic may immediately organize the relevant departments to formulate and implement the contingency plan, and report to the higher people's government and the State Animal and Plant Quarantine Bureau.

Posts and telecommunications, transport departments of major animal and plant epidemic report and inspection materials should be given priority delivery.

Article 5 Foreign animals and plants, animal and plant products and other quarantine objects that are used by foreign institutions and persons enjoying diplomatic, consular privileges and immunities shall be subject to quarantine according to the provisions of the Entry and Exit Animal and Plant Quarantine Law and these Regulations; When the phytosanitary organ inspects, it shall abide by the relevant laws.

Article 6 The Customs shall, in accordance with the law, cooperate with the port animal and plant quarantine office to supervise the entry and exit of animals and plants, animal and plant products and other quarantine objects. The specific measures shall be formulated by the competent agricultural administrative department of the State Council in conjunction with the General Administration of Customs.

Article 7 The list of countries and regions popularized by animal and plant epidemic areas and animal and plant epidemic diseases referred to in the Entry and Exit Animal and Plant Quarantine Law shall be determined and promulgated by the administrative department of agriculture under the State Council.

Chapter II quarantine approval

Article 9 The quarantine inspection and approval of the prohibited substances listed in the first paragraph of Article 5 of the Animal and Animal Products Quarantine Law shall be carried out by the State Animal and Plant Quarantine Bureau or its authorized port animal and plant quarantine office.

The quarantine approval of the input of plant seeds, seeds and other breeding materials shall be carried out by the organ under the provisions of the Phytosanitary Regulations.

Article 10 Those who meet the following conditions shall apply for the examination and approval procedures for entry and exit quarantine:

(A) the export of countries or regions without major flora and fauna;

(2) complying with the provisions of the laws, regulations and rules and regulations concerning animal and plant quarantine in China;

(3) comply with the bilateral quarantine agreement (including quarantine agreement, memorandum, etc.) signed by China and the exporting country or region.

Article 11 The procedures for quarantine examination and approval shall be completed before the signing of the trade contract or agreement.

Article 12 Those who carry or mail plant seeds, seedlings and other breeding materials shall submit their applications in advance and handle the formalities for quarantine inspection and approval. If the special circumstances can not be handled in advance, the person or the mailer shall submit the quarantine inspection and approval procedures at the port , Approved by the examination and approval authorities and quasi-quasi-quasi-quasi-quasi-qualified.

Article 13 Where the transferee transports the cargo, the owner or his agent must submit a written application to the State Animal and Plant Quarantine Bureau in advance and submit it to the animal and plant quarantine office of the exporting country or region for proof of the epidemic situation, and enter the national or regional government animal and plant quarantine Issued by the authorities to permit the entry of the animal documents, and that the proposed transit route, the State Animal and Plant Quarantine Bureau to review the consent of the issue of "animal transit permit."

Article 14 Where a prohibited entry is listed in the first paragraph of Article 5 of the Entry and Exit Animal and Plant Quarantine Law for the special needs of scientific research, the owner, the owner or his agent Person must submit a written application, indicating its quantity, use, introduction, after the epidemic prevention measures, together with the relevant port animal and plant quarantine authorities signed the views.

Article 15 After passing the examination and approval procedures for entry and exit quarantine, the owner, the owner or his agent shall reapply for the quarantine inspection and approval procedures if any of the following circumstances:

(1) altering the variety or quantity of the imported goods;

(2) altering the exporting country or region;

(3) altering the port of entry;

(4) exceeding the validity period of quarantine approval.

Chapter III Entry Quarantine

Article 16 The quarantine requirements of China as stipulated in Article 11 of the Entry and Exit Animal and Plant Quarantine Law refer to the laws and administrative regulations of China and the requirements for animal and plant quarantine provided by the administrative department of agriculture under the State Council.

Article 17 The State shall apply the registration system for the production, processing and storage of foreign products for exporting animal and plant products to China. The specific measures shall be formulated by the administrative department of agriculture under the State Council.

Article 18 In the case of importation of animals and plants, animal and plant products and other quarantine objects, the owner or his agent shall submit the inspection to the animal and plant quarantine office at the port of entry before entering or entering the territory. The owner or his agent shall notify the relevant port animal and plant quarantine office when it is transferred to the designated place for quarantine of the customs supervision area. If the goods are transferred, the owner or his agent shall report to the animal and plant quarantine office at the port of entry at the time of entry. When arriving at the destination, he shall report to the animal and plant quarantine office at the port of destination.

Input of livestock and poultry and its semen, embryo, should be 30 days before entry inspection; importation of other animals, should be 15 days before entry inspection; import plant seeds, seedlings and other breeding materials, should be in 7 days before the entry inspection.

Animal and plant packaging, bedding material entry, the owner or his agent should promptly declare to the port animal and plant quarantine offices; animal and plant quarantine authorities can be based on specific circumstances of the declaration of the implementation of quarantine.

The animal and vegetable packaging materials and bedding materials referred to in the preceding paragraph refer to animal products and plants and plant products directly used as packaging materials and bedding materials.

Article 19 When submitting inspection documents to the port animal and plant quarantine office, it shall submit the inspection certificate and submit the quarantine certificate, certificate of origin and trade contract, letter of credit, invoice and other documents issued by the government or animal and plant quarantine office of the exporting country or region; If the quarantine examination and approval procedures are to be handled according to law, the quarantine approval form shall also be submitted. The export quarantine organ issued by the animal and plant quarantine office of the exporting country or region or the formalities for quarantine examination and approval according to the law shall not be returned or destroyed according to the specific circumstances.

Article 20 When the imported animals and plants, animal and plant products and other quarantine objects are transported to the port, the quarantine personnel may carry out the quarantine on the means of transport and the goods at the scene, and check whether the goods or certificates are consistent and may take samples according to the regulations. The carrier, the owner or his agent shall provide the quarantine officer with a loading list and relevant information.

Article 21 When the means of transport of animals arrives at the port, the upper and lower means of transport or the personnel close to the animal shall accept the epidemic prevention and disinfection carried out by the port animal and plant quarantine office and carry out other on-site preventive measures taken by the port animal and plant quarantine office.

Article 22 Quarantine personnel shall carry out on-site quarantine according to the following provisions:

(A) animal: check the clinical symptoms of disease. Article 23 For large flora and fauna products shipped on ships and trains, they shall be checked in situ; those that are limited to the storage conditions of ports and stations can not be checked in situ and, with the consent of the port animal and plant quarantine office, Transport, will be shipped to the designated location of animal and plant products. Article 24 For the importation of large and medium-sized livestock, it shall be quarantined and quarantined for 45 days for animal isolation and quarantine places established by the State Animal and Plant Inspection and Quarantine Bureau. Article 26 For the import of animals and plants, animal and plant products and other quarantine objects, in accordance with China's national standards, industry standards and the State Animal and Plant Quarantine Bureau of the relevant provisions of the implementation of quarantine.

Article 27 In the case of importation of animals and plants, animal and plant products and other quarantine objects, if the quarantine is qualified, the port animal and plant quarantine office shall seal the declaration form or issue the "quarantine release notice"; If the quarantine office of the customs supervision area is issued by the animal and plant quarantine office at the port of entry, the "quarantine dispatch notice" shall be issued. The owner or his agent with the port animal and plant quarantine authorities in the declaration of stamps or issued a "quarantine release notice", "quarantine transfer notice" for customs clearance, delivery procedures. Article 29 The State Animal and Plant Quarantine Bureau may send quarantine personnel to carry out pre-examination, supervision or production of epidemic situation investigation in accordance with the quarantine requirements and the consent of the relevant organs of the government or animal and plant products.

Article 30 The illegal animals and plants, animal and plant products and other quarantine objects intercepted by customs, border and other departments shall be quarantined by the port animal and plant quarantine office.

Chapter IV outbound quarantine

Article 31 When the owner or his agent handles the exit inspection procedures for animal and plant, animal and plant products and other quarantine objects according to law, a trade contract or agreement shall be provided.

Article 32 Where the importing country requires that China register the production, processing and storage units of animal and plant, animal and plant products and other quarantine objects exported to it, the port animal and plant quarantine office may apply for registration and report to the State Phytosanitary Bureau for the record.

Article 33 Where an animal is exported or quarantined, it shall be quarantined at the quarantine place designated by the animal and plant quarantine office at the port.
